Employment Law and Workers Compensation Attorney

Position Overview:
The Employment Law and Workers Compensation Attorney dual role that will be responsible for all employment-related legal matters pertaining to the company, including litigation matters on behalf of the company. You will be representing the company in all current and future employment litigation matters. The ideal candidate will advise the HR team and other business leaders about employment and labor law issues including discrimination, wrongful termination, wage and hour, ADA/FMLA, etc. Will also be handling 100 plus files and will need to have strong organizational, writing, communication, litigation, and negotiation skills. Duties will include, but are not limited to trials, hearings, reviewing medical reports, discovery; must be able to handle all aspects of workers' compensation claims from start to finish.

Position Responsibilities:

  • Research, develop and implement employment law related compliance procedures and best practices
  • Strategically manage and oversee outside counsel representing the company in litigation matters and formal proceedings and advises management on legal matters to guard the organization against legal liability.
  • Counsel management and the Human Resources team on new or pending federal and state legislation, laws, rules and regulations, industry developments, and trends that affect the company and its operations.
  • Advise and provide counsel on labor and employment-related matters which may include, but are not limited to, wage and hour law, human resources, workers' compensation, unemployment, and other state agency claims, employee relations, employment agreements, policy-related issues, FMLA and other states/local leave matters, employment-related litigation, internal employee investigations, and arbitrations.
  • Develop strategy and actively manage litigation and claims portfolio from inception to conclusion, including the development and execution of effective litigation management (including discovery) and settlement strategies, budget and outside counsel management, and the negotiation and resolution of pre-litigation disputes
  • Interface and communicate promptly and effectively with clients, employers, TPAs, attorneys, claims examiners, claims managers, support staff, lien claimants, colleagues, healthcare providers, other law firms, court officials
  • Provide effective, substantive, and timely reporting, communications, information, legal advice, and other services to clients and claims on legal and factual issues.
  • Maintain caseload with minimal supervision.
  • Prepare for attendance at hearings, depositions, cross examinations, arbitration, informal settlements, conferences, meetings, etc.
  • Ability to travel to and from the various locations where his or her job tasks take place such as Workers' Compensation Appeals Board, doctors' offices, and other deposition locations Qualifications:
    • 5- 10 years' experience of years of substantive labor and employment experience (including Litigation Experience) preferably as an In-House Employment Law Attorney or Employment Defense Attorney.
    • Experience in handling labor and employment matters before federal, state courts and administrative agencies.
    • Familiarity and expertise in Labor & Employment law.
    • Knowledge of California Code of Civil Procedure and California Rules of Court is an essential qualification, federal law experience a plus.
    • Must have a JD degree from an accredited law school and be barred in the state of California with good standing.
    • Must have active California State Bar membership in good standing.
    • Knowledge of WCAB court rules and procedures.
    • Must be well organized with excellent oral and written communication skills.
    • Ability to travel to and from the various locations where his or her job tasks take place such as Workers' Compensation Appeals Board, doctors' offices, and other deposition locations
    • Familiarity with the latest developments in the practice of law, as well as pertinent knowledge in related fields. Job Requirements:
      • Represent insured in litigation of workers compensation claims
      • Represent insured employers in litigation of workers compensation claims
      • Provide input on specific legislative/regulatory agenda for workers compensation
      • Specialize in handling litigated files focusing on workers compensation claims throughout the state of Mississippi
      • Providing superior and cost effective workers' compensation legal representation for the policyholders of the Company
      • Assist with training claim personnel on various aspects of workers compensation law, including litigation process and procedures
      • Understanding of medical, scientific, construction, products, engineering and similar issues inherent in workers compensation cases
      • Drafting executive employment and bonus agreements, equity and cash incentive compensation plans and agreements, executive separation agreements and severance plans, and nonqualified deferred compensation arrangements and trusts
      • Function as a 'junior associate' attorney responsible for supporting defense of workers' compensation cases from minor to significant injuries or death and support litigation for assigned caseload
      • Seek a workers' compensation attorney to supervise attorneys and to provide employers and insurance companies with the best possible legal expertise in the area of workers compensation law
      • Handle all aspects of workers compensation litigation, including developing claims strategies, drafting and filing pleadings, motions, and discovery, taking and defending depositions
      • Develop professional judgments and discretion with guidance from more experienced team members; autonomy, growth, and teamwork
      • Sit in either downtown Chicago or northwest suburban office
      • Dedicated solely to the representation of injured persons with an emphasis on providing each client with an exemplary level of service
      • Handle a full case-in-chief caseload
      • Handle all aspects of workers 'compensation litigation, including developing claims strategies, drafting and filing pleadings, motions, and discovery, taking and defending depositions
      • Provide employers and insurance companies with the best possible legal expertise in the area of workers compensation law
      • Represent the Company and insureds in all phases of workers' compensation litigation, practicing law in compliance with ethical standards as established by state law
      • Work in Staff Legal Office in Tampa, FL
      • Assist individuals who have been injured on the job file to pursue claims to recover compensation for injuries, including medical bills and lost wages
